The agreement between ICEP Europe and the Student shall incorporate and be bound by the
following terms and conditions.

Definitions

‘The Studentโ€™ means the student enrolling for the Course.

‘The Courseโ€™ refers to the course offered by ICEP Europe and chosen by the student. The course is fully online and the dates of the course shall be as specified on the ICEP Europe website.

Terms and Conditions

This is an online information and communication service provided by Profexcel Ltd. trading as ICEP Europe, subject to your compliance with the terms and conditions set forth below, including all information which is available in the registration process and on this service and incorporated by reference in these terms and conditions.

1. Modifications

ICEP Europe may modify these terms and conditions and the Disclaimer at any time and such modifications shall be effective immediately upon either posting of the modification on the site or notifying to you. You agree to review the agreement periodically to be aware of such modifications and your continued access or use of the service shall be deemed your conclusive acceptance of any such modification.

2. Links

Although the site includes links providing direct access to other Internet sites ICEP Europe takes no responsibility for the content or information contained on those other sites, and does not exercise any editorial or other control over those sites.

3. Copyright

All materials posted on this site are subject to copyrights owned by ICEP Europe and other individuals and entities. Any reproduction, retransmission or republication of all or part of any document found on this site is expressly prohibited, unless ICEP Europe or the copyright owner of the material has expressly granted its prior written consent to so reproduce, retransmit, or republish the material. All other rights reserved.

4. ICEP Europe

The names, trademarks, service mark and logos of ICEP Europe appearing on this site may not be used in any advertising or publicity, or otherwise to indicate ICEP Europe’s sponsorship of or affiliation with any product or service without ICEP Europe’s prior express written permission.

5. Termination

ICEP Europe may terminate your access to this site at any time without cause or notice.

6. Communication

The Student shall provide his or her electronic address at which ICEP Europe may communicate with the Student for all purposes in relation to the course purchased. The Student shall notify ICEP Europe of any change in this address. In the absence of notification by the Student of a change in his or her electronic address, ICEP Europe shall be entitled to communicate with the Student at the electronic address provided by him or her notwithstanding any apparent refusal or failure of communication. The Student shall be entitled to communicate with ICEP Europe at its electronic or physical address and ICEP Europe shall notify the Student promptly of any change in these addresses.

7. Application for Enrolment

The Student shall apply to enrol on the Course by completing the electronic enrolment form available on our website.

8. Price and Payment

The course fee shall be as specified on the ICEP Europe website and includes payment for course materials to be made available to the Student by electronic communications together with all necessary information and on-line assistance to access and use the course materials.

The course fee is payable in full in advance. On acceptance of the Studentโ€™s application and receipt of the course fee ICEP Europe shall register the student on the Course and ICEP Europe shall notify the student of his or her registration by e-mail.

Where a studentโ€™s fee is to be paid by an institution or their employer etc. a completed application form and an official purchase order quoting the course price, together with the full details (direct phone number and address) of the person responsible for payment, must be submitted in advance.

9. Cancellation

If the student cancels his or her participation on the course more than 14 days prior to its commencement ICEP Europe shall be entitled to retain 30% of the course fee for its administrative and other costs and the student shall be entitled to a refund of 70% of the course fee paid by him.

If the student cancels within 14 days of the date for the commencement of the course or after it has commenced he or she shall not be entitled to a refund.

ICEP Europe may cancel a course at any time for any reason and in that event shall be liable only to repay to the student the amount of the course fee paid by him or her and ICEP Europe shall not be liable for any loss or damage or consequential loss howsoever arising and suffered by the student as a result of the said cancellation.

In the event of cancellation the student shall not be permitted any further access to the course material.

10. Copyright and Intellectual Property

The copyright in all course material belongs to ICEP Europe. The student shall not cause or permit anything, which may damage or endanger the copyright or intellectual property of ICEP Europe or ICEP Europeโ€™s title to it or assist or allow others to do so. The student agrees to notify Profexcel immediately of any misuse or infringement of ICEP Europeโ€™s copyright or intellectual property of which the student becomes aware.

Governing Law and Jurisdiction

The agreement between ICEP Europe and the student shall be governed by the law of Ireland in every particular including formation and interpretation and shall be deemed to have been made in Ireland.

Proceedings arising out of the agreement may be brought in any Irish Court of competent jurisdiction at Dublin, Ireland but the submission by the parties to such jurisdiction shall not limit the right of ICEP Europe to commence any proceedings arising out of this agreement in any other jurisdiction that it may consider appropriate.

Data Protection

ICEP Europe shall comply with all obligations under the Data Protection Legislation (GDPR and Data Protection Acts) in respect of personal information and data provided by the Student. For full Privacy Policy click on ‘Privacy Policy’ at the bottom of the page.
